I’ve started checking my grey hairs. 🔎 I’d chatted with an employee who worked not far from where I went to school 🏫 who had been offered a settlement agreement 📑. I was checking my grey hairs because, in the time that he’d been with his employer, I had:- 🏫 Finished school.🏫 Been to Sixth Form.👨🏻🎓 Done my undergraduate degree at university.⚖️ Done a university work placement with the Crown Prosecution Service.👨🏻🎓 Done my postgraduate studies at university.📜 Completed my training contract to become a solicitor.💼 Been an employed solicitor from 2016 to 2021 (with a brief sidestep into HR).🧡 Become a self-employed solicitor in 2021.That’s 16 years that hasn’t felt that long at all!!!! 😱😱😱😱 However, far scarier… 😱 During that time, this employee had:- 📈 Risen through the ranks of his own profession to lead his team.🏹 Spearheaded several projects for his employer.😃 Enjoyed working with his employer and colleagues.➡️ Then been marginalised and effectively forced out of his job by a change in management.❌ Been accused of misconduct, the details of which hadn’t even been given to him to allow him to defend himself.😓 Suffered work-related stress.📑 Been offered an employment-related settlement agreement.💷 And…wasn’t even being paid non-taxable compensation on top of what he was already entitled to under his employment contract for waiving his employment rights…including his right to go to a court or employment tribunal! How bad is that? 😱😱😱😱😱😱😱😱😱It makes me wonder whether employers like that - who try to get employees to leave their long-term employment for peanuts 🥜 in circ*mstances that scream of constructive unfair dismissal and perhaps even disability discrimination - would be very happy if someone offered them next to nothing to sign away their legal rights…? 🤔 No wonder I’m getting grey hairs 👨, having to put things like that right! ✅ #work #employment #law

Strongly considering giving the Law Offices of Kenneth Hiller another call in regards to these Human Rights Cases I have.Before we go further, only reason why I'm contemplating this move is because I need some closure in the matter. The way I see it, my new employer reminded me that when I had my ADAAA Claim with Unum, I should have been allowed 48 Hours every week for appointments by law. The way I see it, all the New York State Department of Labor did for me was complicate my journey to find a new job. Now that I'm signed with a employer, I'm glad and I'm looking forward to April 29th. So I'm coming in on that day to be taught how I can be better then I'm already am.But the whole ordeal with Continuum Global Solutions and the New York State Department of Labor did kind of leave a mark on me. And being honest, I just need 2 things...The Closure in order to focus even more then I am now. And because they took turns besmirching my name...Compensation is in order. So tomorrow morning, I need to check in with Demond Meeks and follow up on the call I made a week ago, then I'm calling for consultation in regards to looking at legal actions, then Physical Therapy, then family time. My new employer deserves my best. No matter what, that's exactly what they're going to get from me. But this treatment from the New York State Department of Labor is something I can't turn away from until Friday April 26, 2024. Because both Continuum Global Solutions and the New York State Department of Labor second guessed me, disqualified me from paying jobs unfairly, only to be hired by the company I wanted to work for in the first place, getting paid how I should have when I was with Verizon.Life is good in that way, but I can't shake this ongoing nightmare of New Yorkers being mistreated by the DOL, and the ongoing nightmare of New Yorkers being abused and gaslit while being employed for Continuum Global Solutions and being paid 25% then a V-Teamer.These 2 examples are prime definitions of what is wrong with the working world that we know now. Allow me to give my people the example of the best customer service that I can. Something good has to come out of Rochester.

In a move to promote equal employment opportunities, California has revamped the Fair Chance Act. As of October 1, 2023, employers must navigate new guidelines when considering criminal history. Here's a snapshot:1️⃣ No criminal history inquiries pre-job offer, except where legally required (e.g., law enforcement roles).2️⃣ Job ads can't exclude those with a criminal history.3️⃣ Certain categories of history, like non-convictions, can't be considered.4️⃣ After a conditional job offer, a thorough assessment is needed if a job denial based on criminal history is anticipated.Employers, make sure to consult legal counsel to align your screening policies with these new regulations. My Friday posts integrate the law with personal stories or the day's national day. I assist small businesses in setting up their legal business structure and draft all accompanying documents required for a new business, some of which includes: operating agreements, employee handbooks, contracts, and leases. Employees come to me for representation when they have been discriminated against in the workplace because of their disability, sex, age, gender, religion, race, ethnicity, veteran status, or pregnancy. I represent employees who have been retaliated against or wrongfully terminated. I have been focusing on assisting disabled individuals who need accommodations in the workplace and drafting employee handbooks. Employers come to me for representation to defend retaliation and wrongful termination lawsuits as well as to draft employment contracts, severance agreements, non-competes, non-solicitation agreements, employee handbooks, and pandemic policies. It is unusual to be both a business attorney and employment law attorney. One is either one or the other, not often both. Because of this clients have an advantage in using one and the same attorney for all their business and employment legal needs. Using one attorney means that there is a continuity of legal services.
